Policy on personal data processing
1. General provisions
The present policy of personal data processing is made in accordance with the requirements of the Law of Ukraine, 2010, № 34, ст. 481 «On Protection of Personal Data» and determines the procedure for processing personal data and measures to ensure the security of personal data taken by the Design and Architecture Studio "YAD design" (hereinafter - the Operator).
1.1. The Operator sets as its most important goal and condition for carrying out its activity the observance of human and citizen's rights and freedoms in the process of personal data processing, including the protection of the rights to privacy, personal and family secret.
1.2. This policy of the Operator regarding the personal data processing (hereinafter referred to as the Policy) applies to all information that the Operator can obtain about the visitors of the website http://yaddesign.com.ua/.
2. The main concepts used in the Policy
2.1. Automated processing of personal data - processing of personal data by means of computer technology;
2.2. Personal data blocking - temporary cessation of personal data processing (except for cases when processing is necessary to clarify personal data);
2.3. Website - a set of graphic and information materials, as well as computer programs and databases that ensure their availability on the Internet at http://yaddesign.com.ua/;
2.4. Information system of personal data - an aggregate of personal data contained in databases and ensuring their processing by information technologies and technical means;
2.5. Impersonalization of personal data - actions as a result of which it is impossible to determine without using additional information the belonging of personal data to a specific User or other personal data subject;
2.6. Personal data processing - any action (operation) or set of actions (operations), performed with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data;
2.7. Operator - a state authority, a municipal authority, a legal entity or an individual, independently or jointly with other persons, which organize and (or) carry out processing of personal data, as well as determine the purposes of personal data processing, the composition of personal data to be processed, actions (operations) performed with personal data;
2.8. Personal data - any information related directly or indirectly to a certain or defined User of the website http://yaddesign.com.ua/;
2.9. User - any visitor of the http://yaddesign.com.ua/ website;
2.10. Provision of personal data - actions aimed at disclosing personal data to a certain person or a certain circle of persons;
2.11. Dissemination of personal data - any actions aimed at disclosure of personal data to a certain person or a certain circle of persons (transfer of personal data) or at familiarization with personal data of an unlimited circle of persons, including disclosure of personal data in mass media, placement in information and telecommunication networks or providing access to personal data in any other way;
2.12. Transborder transfer of personal data - transfer of personal data on the territory of a foreign state to a foreign authority, foreign individual or foreign legal entity;
2.13. Destruction of personal data - any actions as a result of which personal data are irretrievably destroyed with the impossibility of further restoration of personal data content in the information system of personal data and (or) destruction of material personal data carriers.
3. The Operator may process the following personal data of the User
3.1. E-mail address;
3.2. Phone numbers;
3.3. The site also collects and processes impersonal data about visitors (including "cookies") through the services of Internet statistics.
3.4. The above data further in the text of the Policy are united by the general concept of Personal Data.
4. Purposes of personal data processing
4.1 The purpose of processing the User's personal data is to inform the User by sending e-mails.
4.2 The Operator is also entitled to send the User notifications about new products and services, special offers and various events. The User can always refuse to receive information messages, by sending a letter to the Operator to the e-mail address post@yaddesign.com.ua with the note "Refusal from notifications about new products and services and special offers".
4.3. Impersonalized data of the Users, collected by means of the Internet-statistics services, are used to collect information about the Users' actions at the site, improve the quality of the site and its content.
5. Legal grounds for processing personal data
5.1 The Operator processes the personal data of the User only in case of their filling in and/or sending by the User himself through special forms, located at http://yaddesign.com.ua/. By filling in the corresponding forms and/or sending the personal data to the Operator, the User expresses his consent to this Policy.
5.2 The Operator processes the impersonal data about the User in case it is allowed in the settings of the User's browser (saving of cookies and use of JavaScript technology is enabled).
6. The procedure of collection, storage, transfer and other types of personal data processing
The security of personal data, which are processed by the Operator, is ensured by implementing legal, organizational and technical measures necessary for the full implementation of the requirements of the current legislation in the field of personal data protection.
6.1. The Operator ensures the personal data safety and takes all possible measures to exclude the access to the personal data of the unauthorized persons.
6.2 The personal data of the User will never, under any conditions, be transferred to the third parties, except the cases connected with the execution of the current legislation.
6.3 In case of revealing the inaccuracies in the personal data, the User can update them independently, by sending the notice to the Operator's e-mail address post@yaddesign.com.ua with the note "Updating of personal data".
6.4 The period of personal data processing is unlimited. The User can at any moment revoke his consent to the processing of the personal data by sending a notice by e-mail to the Operator's e-mail address post@yaddesign.com.ua with the note "Revoke the consent to the processing of personal data".
7. Cross-border transfer of personal data
7.1. The operator, before starting the trans-border transfer of personal data, is obliged to make sure that the foreign state on whose territory the transfer of personal data is supposed to be carried out ensures the reliable protection of the personal data subjects' rights.
7.2. The transborder transfer of personal data on the territory of foreign states that do not meet the above mentioned requirements can be carried out only if the personal data subject has consented in writing to the transborder transfer of his personal data and /or execution of the contract, to which the personal data subject is a party.
8. Final provisions
8.1. The User can get any explanations on the questions of interest concerning the processing of his personal data by contacting the Operator by e-mail post@yaddesign.com.ua.
8.2 Any changes in the policy of personal data processing by the Operator will be reflected in this document. The policy is valid for an indefinite period of time until its replacement by the new version.
8.3. The current version of the Free Access Policy is available on the Internet at http://yaddesign.com.ua/informationprotectionpolicy.
